Terms of Service

These Terms govern your use of Fuelbit, operated by [YOUR FULL NAME], a sole proprietorship (Einzelunternehmen) in Weimar, Germany (see the Impressum for full contact details). By downloading, installing, or using Fuelbit, you agree to these Terms of Service. If you do not agree, do not use the app.

Fuelbit is a mobile application that uses AI to identify food from photos and estimate nutritional values. It also provides water tracking, intermittent fasting tracking, and a virtual AI nutrition companion. Fuelbit offers a free tier and an optional paid subscription ("Premium").

The subscription runs on a monthly term and renews automatically. You can cancel at any time with effect from the end of the current billing month; after any initial term the contract is always terminable on a monthly basis (§ 309 Nr. 9 BGB). For website subscriptions you can cancel using the cancellation button ("Verträge hier kündigen", § 312k BGB) without logging in; for app-store subscriptions, cancel via the app store. Cancellation stops future renewals; it does not retroactively refund the current period unless required by law.

As a consumer you have a 14-day right of withdrawal for the paid subscription. The full Widerrufsbelehrung and the withdrawal button (§ 356a BGB) are provided during checkout. If you ask us to begin providing the paid service before the withdrawal period ends, you expressly consent to immediate performance and acknowledge that your right of withdrawal lapses once the service has been fully provided; if you withdraw during performance, you pay a proportionate amount for what was already provided.

Statutory withdrawal and warranty rights are unaffected. Beyond these, subscription fees are generally non-refundable for the current billing period. App-store purchases are refunded according to the relevant app store's policy.

Nutrition data provided by Fuelbit is an estimate only. It should not be used as the sole basis for medical, dietary, or clinical decisions. Always consult a qualified healthcare professional or registered dietitian before making significant dietary changes, especially if you have a medical condition.

All content, code, design, and trademarks in Fuelbit are the property of the developer. You are granted a limited, non-exclusive, non-transferable licence to use the app for personal, non-commercial purposes.

You retain ownership of photos you upload. By uploading photos, you grant us a limited licence to process them solely for the purpose of providing the food analysis feature. We do not use your photos for any other purpose.

We aim to keep Fuelbit available at all times but do not guarantee uninterrupted access. We may suspend, modify, or discontinue the service at any time with reasonable notice.

To the maximum extent permitted by applicable law, Fuelbit and its operator are not liable for any indirect, incidental, special, or consequential damages arising from your use of the app or reliance on nutritional data provided. Nothing in these Terms excludes or limits our liability for intent or gross negligence, for injury to life, body or health, or any other liability that cannot be excluded or limited under mandatory law.

These terms are governed by the laws of Germany. This does not deprive you, as a consumer, of the protection of mandatory provisions of the law of your country of residence.

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).

We may update these terms. Continued use of the app after updates constitutes acceptance of the new terms.
